A Note on Trademarks & Exclusivity

A question you might have is: "Can I copyright/trademark this logo for my club?" Because I sell these designs non-exclusively to keep prices affordable for everyone, they cannot be copyrighted/trademarked.

Hassle-Free License Details

1. Parties and Asset Identification

  • Licensor: Silvertip Sports Creative
  • Licensee: The Customer/Organization

2. Grant of License

This license is Non-Exclusive. The Licensor and other customers/organizations that have also completed a purchase of the same Asset, retain the right to use the Asset.

Q: Can I trademark or copyright this Asset?

A: No. All Assets available on the Silvertip Sports Creative website are sold non-exclusively. If you would like a custom design that you can trademark/copyright, please contact directly.

  • Permission of Use: When buying for a team/club/organization, anyone under this entity may freely use the asset without needing to buy any additional licenses. 
  • Ex: You are a football coach for “Eastwood High School” this means other coaches, teachers, admin, or students at Eastwood may also use the asset freely.

3. Permitted Uses

The Licensee MAY use the Asset for the following purposes:

  • Physical Products for Resale: Apparel, uniforms, stationery, stickers, posters, etc.
  • Promotional Materials: Packaging, brochures, advertisements, and video commercials, etc.
  • Editorial & Media: Books, news publications, and broadcast, etc.
  • Web Graphics: Digital files for websites, online banners, social media, etc.

4. Prohibited Uses (Restrictions)

The Licensee shall not:

  • Resell, sub-license, rent, or otherwise redistribute the Asset as a standalone digital file for profit. This includes assigning or gifting your rights under this Commercial License to any other person or entity outside of your team/club/organization.
  • “Can I provide these files to vendors for printing and production purposes?” - Yes!
  • Do not post the Asset (or depictions of it) on freelance marketplaces or design service websites (e.g., Fiverr, Upwork, 99Designs, etc).
  • The Asset may not be integrated into any mockup software or web-based tool that grants other users the ability to manipulate, download, or re-export the design without an independent license (e.g. Custom Ink, Printful, Blue Cotton, etc). 
  • Claim authorship or ownership of the Asset.

5. Ownership and Intellectual Property

  • The Licensor retains all copyrights, trademarks, and intellectual property rights associated with the Asset. This agreement is a license to use, not a transfer of ownership.

6. Modifications and Derivative Works

  • The Licensee IS permitted to modify, alter, or create derivative works based upon the Asset.

7. Credit and Attribution

  • No Credit or Attribution is required in any instance, though if you would like to share your asset being used, that is highly encouraged!

8. Termination

  • This agreement remains in effect until terminated. The Licensor may terminate the license immediately if the Licensee breaches any terms. Upon termination, the Licensee must cease all use of the Asset and delete any copies.
